The Crime Situation in D.C.
Washington D.C. has been grappling with a significant increase in crime. In 2023, the city witnessed a devastating 39% increase in violent crime and a 26% increase in crime overall1. The most frequent criminal act in Washington is carjackings, with motor vehicle thefts increasing by a staggering 82% in 20232.
The Secure DC Omnibus Amendment Act of 2024
In response to the escalating crime rates, the D.C. Council has passed the Secure DC Omnibus Amendment Act of 20243. This legislation, which was unanimously passed, is designed to address the growing crime crisis in the District and what Mayor Muriel Bowser has repeatedly referred to as gaps in the system3.
The Secure DC Omnibus Amendment Act of 2024 combines proposals seen in a dozen crime bills introduced in 2023, including the Safer Stronger Amendment Act and the Addressing Crime Trends (ACT) Now Amendment Act1. The bill aims to redefine offenses and penalties, as well as expand defendants’ rights to a jury trial4.
Key Provisions of the Bill
The bill includes several key provisions aimed at curbing crime:
- Drug-Free Zones: The bill would allow the D.C. police chief to declare drug-free zones for five days. In a drug-free zone, police could ask anyone in a group of two or more people believed to be there with the purpose of committing a drug-related crime to disperse; if they refuse, they could be arrested1.
- New Felonies: The bill would add a host of new felonies for both violent and property crimes. Strangulation would become a stand-alone felony1.
- Endangerment with a Firearm: It would create a new felony offense for “endangerment with a firearm,” meaning someone who fires a gun in public and doesn’t hit anyone can still face a felony1.
- Organized Retail Theft: Organized retail theft, where thieves pick apart grocery store aisles and luxury stores to later resell the merchandise or return it for a refund, would be a new felony offense1.
Controversies and Concerns
Despite the unanimous passage, the bill has sparked some controversy. D.C. Police Chief Robert Contee has expressed concerns about decreasing the penalties for gun crimes4. He believes that reducing penalties for crimes that are particularly impactful to community members is a non-starter4.
The Secure DC Omnibus Amendment Act of 2024 represents a significant step in addressing the crime crisis in Washington D.C. However, its effectiveness will ultimately be determined by its implementation and the city’s ability to address the root causes of crime.
